These terms apply to the entire website and any email or other type of communication between you and Mulcon Financial Services and its subsidiaries or affiliates with whom Mulcon resell their services.

Under no circumstances shall Mulcon Financial Services team be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site, even if Mulcon Financial Services team or an authorized representative has been advised of the possibility of such damages. If your use of materials from this site results in the need for servicing, repair or correction of equipment or data, you assume any costs thereof.

Mulcon Financial Services will not be responsible for any outcome that may occur during the course of usage of our resources. We reserve the rights to change prices and revise the resources usage policy at any moment.

Return and Refund Policy

Thank you for purchasing any of our products and services here at Mulcon Financial Services . We appreciateCancellation due to quality of service If for any reason you are not entirely satisfied with our service then you can cancel the contract within the first 15 days from the Commencement (initiation of project) date, and we will refund the unused amount of your fees in full for Prepaid plans, and refund any Milestone (for fixed price projects) that was paid for but not delivered yet. For example, if you have paid for a prepaid hourly plan of 100 hours per month, and you wish to cancel after 7 days after the start of contract where 20 hours were utilized on your project, we will refund the 80 hours that were not used. If however you have requested a product or service from us and it was delivered on time and per requested but your preference has changed we will be more than happy to make any changes. However, any cost associated with those changes will be transferred to you as the client. If dislikes are expressed after following your instructions then we the company will not be liable to provide a refund under such grounds. We shall not be held accountable for lost or expired services due to negligence or none use on your part after 3 months and for which no refund will be given.Payments for custom design projects are made to us in increments as a courtesy to the client. Once a payment or deposit is made, it is non-refundable. If a project is canceled or postponed, all monies paid are retained by Us if applicable, a fee for all work completed beyond what was already paid for shall be paid by the client.When adding new text and/or content to a product the client is responsible for providing all text (in digital format) and images/photos.There are absolutely no refunds for any fees related to website or mobile app development service including maintenance services. An administrative fee of $25 will be charged to the clients account for any late payments or declined credit card charges. You may cancel and renew at any time via your account page on our site. To file a Refund Request, you will need to email us at: support@mulconfinancial.com Note: All refunds are processed within 50 business days after a documented request has been received. Excluding verbal request or request made through any third party with which we hold no obligation.

SEO/Marketing Plans Customer understands, acknowledges, and agrees that Mulcon Financial Services Company & Partners has no control over the policies of search engines or directories with respect to the type of sites and/or content that they accept now or in the future. Customer’s web site may be excluded from any search engine or directory at any time at the sole discretion of the search engine or directory entity. Some search engines and directories may take as long as two (2) to four (4) months, and in some cases longer, after commencement of plan to list and/or update Customer’s website. Occasionally, search engines and directories will drop listings for no apparent or predictable reason. Mulcon Financial Services & Partners is not responsible for changes made to Customer’s web site by other parties that adversely affect the search engine or directory rankings of Customer’s web site. Indemnification – Customer shall indemnify and hold harmlessMulcon Financial Services Company & Partners (and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees) from any and all claims, damages, liabilities, costs, and expenses (including, but not limited to, reasonable attorneys’ fees and all related costs and expenses) incurred byMulcon Financial Services Company & Partners as a result of any claim, judgment, or adjudication against Lead Generation App Company & Partners related to or arising from (a) any photographs, illustrations, graphics, audio clips, video clips, text, data or any other information, content, display, or material (whether written, graphic, sound, or otherwise) provided by Customer toMulcon Financial Services Company & Partners (the “Customer Content”), or (b) a claim thatMulcon Financial Services & Partners use of the Customer Content infringes the intellectual property rights of a third party. To qualify for such defense and payment, Mulcon Financial Services Company & Partners must: (i) give Customer prompt written notice of a claim; and (ii) allow Customer to control, and fully cooperate with Customer in, the defense and all related negotiations.

Your Suggestions

Any feedback, comments, ideas, improvements or suggestions (collectively, "Suggestions") provided by you to Mulcon Financial Services with respect to the website/app shall remain the sole and exclusive property of Mulcon Financial Services .

Mulcon Financial Services shall be free to use, copy, modify, publish, or redistribute the Suggestions for any purpose and in any way without any credit or any compensation to you.

This Agreement will terminate immediately, without prior notice from Mulcon Financial Services , in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the website/app and all copies thereof from your computer.

Upon termination of this Agreement, you shall cease all use of the website/app and delete all copies of the website/app from your computer.

Termination of this Agreement will not limit any of Mulcon Financial Services 's rights or remedies at law or in equity in case of breach by you (during the term of this Agreement) of any of your obligations under the present Agreement.

YOU AND Mulcon Financial Services AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Agreement shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute waiver of any subsequent breach.

o failure to exercise, and no delay in exercising, on the part of either party, any right or any power under this Agreement shall operate as a waiver of that right or power. Nor shall any single or partial exercise of any right or power under this Agreement preclude further exercise of that or any other right granted herein. In the event of a conflict between this Agreement and any applicable purchase or other terms, the terms of this Agreement shall govern.

Amendments to this Agreement

Mulcon Financial Services reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our website/app after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use Mulcon Financial Services .

Entire Agreement

In the event of a dispute, you or Mulcon Financial Services must give the other a Notice of Dispute, which is a written statement that sets forth the name, address, and contact information of the party giving it, the facts giving rise to the dispute, and the relief requested. You must send any Notice of Dispute via email to: [email protected] Mulcon Financial Services will send any Notice of Dispute to you by mail to your address if we have it, or otherwise to your email address. You and Mulcon Financial Services will attempt to resolve any dispute through informal negotiation within sixty (60) days from the date the Notice of Dispute is sent. After sixty (60) days, you or Mulcon Financial Services may commence arbitration.

Binding Arbitration

If you and Mulcon Financial Services don’t resolve any dispute by informal negotiation, any other effort to resolve the dispute will be conducted exclusively by binding arbitration as described in this section. You are giving up the right to litigate (or participate in as a party or class member) all disputes in court before a judge or jury. The dispute shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Either party may seek any interim or preliminary injunctive relief from any court of competent jurisdiction, as necessary to protect the party’s rights or property pending the completion of arbitration. Any and all legal, accounting, and other costs, fees, and expenses incurred by the prevailing party shall be borne by the non-prevailing party.

Please note that all Promotions may be governed by separate rules that may contain certain eligibility requirements, such as restrictions as to age and geographic location. If you enter any Promotion, you agree to abide by and to comply with all Promotions Rules.

Typographical Errors

In the event a product and/or service is listed at an incorrect price or with incorrect information due to typographical error, we shall have the right to refuse or cancel any orders placed for the product and/or service listed at the incorrect price. We shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account or other payment account in the amount of the charge.

Miscellaneous

If for any reason a court of competent jurisdiction finds any provision or portion of these Terms & Conditions to be unenforceable, the remainder of these Terms & Conditions will continue in full force and effect.
